This Privacy Policy (“Privacy Policy”) describes how we use, collect, process, and share information obtained through the website athttps://penelopeslight.com/(the “Site”).

Why share our Privacy Policy?
As a small business that sells and operates online, we believe that our customers’ privacy is of the utmost importance. We want you to have complete access to our policies and procedures, so that you may understand the ways you can control how we collect, use, and disclose your personal information.

Collected Information

What information do we collect?
We collect personal data and non-personal data about you. “Personal Data” means any data that allows someone to identify you.

The following provides examples of the types of data we collect, and how we collect them. Note that not all of our services collect all of the data listed below. By agreeing to our Privacy Policy, you consent to the collection of the information collected below. In addition to consent, the information is collected to perform a contract, to comply with obligations, or for the legitimate interest of Penelope’s Light or a third party.

We also automatically receive your computer’s device ID (“Device ID” means an ID that is unique to the device or browser on which you access our Site), internet protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and date/time stamp for your visit. This helps us know more about your browser and operating system. You may, however, visit our site anonymously.

Cookies:

Do we use "Cookies"?
Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current Site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about Site traffic and site interaction so that we can offer better Site experiences and tools in the future. How do we use your information?
We may use the information we collect from you when you purchase products, enter a contest or promotion, respond to marketing communication, browse the Site, or use certain other Site features in the following ways:

How do we protect visitor information?
We realize that our customers trust us to protect their Personal Data. We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above. Credit card payment is processed through Ecwid Pay. All credit card information is stored and encrypted in Ecwid Pay’s PCI DSS Level 1 Service Provider compliant server. While we attempt to protect the information in our possession, no security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

Third-Parties

Do we disclose the information we collect to third parties?
We do not sell, trade, or otherwise transfer to third parties your Personal Data unless we provide you with advance notice, except as otherwise described below. The term "third parties" does not include our business. It also does not include website hosting partners and other parties who assist us in operating our Site (i.e., currently, our platform is “powered by” Ecwid to analyze data, process transactions, and payments, and fulfill orders), conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect ours or others' rights, property, or safety.

Third Party Tracking Companies. We use a tool called “Fathom” to collect information about use of our Sites. Fathom anonymously collects information such as how often users visit the Sites, what pages they visit when they visit, and what other sites they used prior to coming to our Sites. We use the information we get from Fathom only to improve the Site. Fathom generates a Random IP address that is anonymously assigned to you during your visit. Keeping your privacy at the forefront. Fathom is a cookie-free analytics tool, so there is no need for a cookie bar on our site. Fathom Terms (https://usefathom.com/terms) and the Fathom Privacy Policy (https://usefathom.com/privacy). 

Social Networks. If you use any features made available to you on our Site by a third party (i.e, Instagram, Pinterest, Facebook, Twitter) it may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook.

Other Third-Party Service Providers. We may share your Personal Data with companies that perform services for us, such as fulfilling orders, delivering packages, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, processing credit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service. We share email activity data with Mailerlite to help us with automated email deployments to consumers for order confirmations, status updates, abandoned cart emails or product review survey emails. While Mailerlite has a license from us to use e-mail addresses and e-mail activity data in their applications, these applications do not share email addresses or any specific email activity data with other third parties that are not our service providers.

Your Choices

You can make the following choices regarding your Personal Data:

Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials related to Penelope’s Light. You can opt out of receiving these emails at any time by following the instructions in the email or by contacting us directly at info@penelopeslight.com. If you decide not to receive promotional emails, we may still send you service and transaction related communications.

Changes To Your Personal Data. Penelope’s Light relies on you to update and correct your Personal Data. You can modify or delete your profile within your registered account. Please note that Penelope’s Light may keep historical information and content in our backup files and archives as permitted by law and to the extent we anticipate that the information may be required in connection with the original purpose of the collection, or as otherwise permitted or required by law or our legitimate interest to comply with foreign law.

Deletion Of Your Personal Data. Typically, we retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required for the operation of purchase transaction or permitted by law or our legitimate interest to comply with foreign law. You can, however, request that we delete your Personal Data. All requests must be directed to the contact in the “Contact Us” section below. We can also decide to delete your data at any time if we believe that the data is incomplete, inaccurate, or that our continued use and storage are contrary to our obligations to other individuals or third parties. In addition, we may keep your Personal Data and usage history as needed to comply with our legal obligations, resolve disputes, and/or enforce any of our agreements.

Revocation Of Consent. If you revoke your consent for the processing of Personal Data, in accordance with this Privacy Policy, then you must discontinue all use of our Site and delete any accounts that you created. In some cases, we may limit or deny your request if the law permits or requires us to do so, or if we are unable to adequately verify your identity.

California Privacy Act

Children’s Privacy

We do not intentionally collect any personal information from children under the age of 13. If you are under the age of 13, you can look at our websites, but you should not make a purchase, register, or submit personal information to us.

Users Outside the United States

If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you understand and agree that the data you provide to us may be processed for the purposes listed in this Policy. You also understand and agree that the data you provide to us may be processed in the United States. U.S. laws regarding the processing of data may be less stringent than the laws of your country. By providing your data, you consent to this processing.

Residents of the European Economic Area
Upon request, residents of the EEA have the right to access the information we process about you, and to request that we correct, modify, or erase that information. You also have the right to opt out of or restrict certain types of processing subject to applicable legal restrictions and our legitimate interest to comply with foreign law. If we need, or are required, to contact you concerning any event that involves your Personal Data we may do so by e-mail, telephone, or mail. 

Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping. In an attempt to provide you with increased value, we may include third party links on our site. These linked sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these linked sites (including if a specific link does not work). We will post any changes to our policy, if we decide to change our privacy policy, on this page. Policy changes will apply only to information collected after the date of the change.

Your CCPA rights are described below. You can make a Request to Know or a Request to Delete under the CCPA by submitting a Privacy Request at the top of this page, or by clicking info@penelopeslight.com.

Right to Know
You have the right to request to know the following about the personal information we have collected about you in the past 12 months:

the categories and specific pieces of personal information we have collected about you
• the categories of sources from which we collect personal information about you
• the business and commercial purposes for which we collect personal information
• the categories of third parties with whom we share the information
• the categories of personal information about you that we disclosed for a business • • • • purpose, and the categories of third parties to whom we disclosed that information for a business purpose

If you make a Request to Know more than twice in a 12-month period, we may require you to pay a small fee for this service.

Right to Delete
You have the right to request that we delete any personal information about you that you have provided to us. We will permanently delete from our records any personal information that is not necessary for our business operations and direct our service providers to do the same.

We consider information to be necessary for our business operations if it is used to:
Complete an obligation to you that you have requested

Detect and resolve issues related to security or functionality
Comply with legal obligations

Right to Non-Discrimination
If you exercise your CCPA consumer rights:
• We will not deny goods or services to you
• We will not charge you different prices or rates for goods or services, including through the use of discounts or other benefits or penalties
• We will not provide a different level or quality of goods or services to you

Request Verification
Before we can respond to any CCPA requests, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft.

The verification process depends on which type of request you make and how you make it. Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request.

For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.

In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:
• If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
• If the only data we have collected about a consumer is gathered through website cookies (i.e., the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.

Authorized Agent

A California resident's authorized agent may submit a Request to Know or a Request to Delete under the CCPA by emailing us at info@penelopeslight.com . Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above. We will also ask for proof that the person who is the subject of the request authorized an agent to submit a privacy request on their behalf. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but consumer verification is not required.
